By accessing our Site or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Description of Service
ShipLogix provides a logistics and shipping consolidation platform designed for Direct-to-Consumer (D2C) ecommerce businesses. We provide access to enterprise-level shipping rates, carrier management, and claims facilitation.
2. Eligibility
You must be at least 18 years of age and represent a valid business entity to use our services. By agreeing to these Terms, you represent and warrant that you meet these requirements.
3. Messaging Policy
By providing your phone number and opting in through our contact forms or booking widgets, you expressly consent to receive non-marketing and marketing text messages (SMS/MMS) from ShipLogix.
Message Types: Messages may include appointment reminders, account updates, shipping notifications, and marketing promotions.
Opt-In: Consent is obtained through a clear, affirmative checkbox on our digital forms. Consent is not a condition of purchase.
Opt-Out: You can cancel the SMS service at any time. Just text "STOP" to the short code or long code from which you received the message. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed.
Help: If you are experiencing issues with the messaging program you can reply with the keyword "HELP" for more assistance, or you can get help directly at [support email].
Frequency: Message frequency varies based on your interaction with the platform.
Carriers: Carriers are not liable for delayed or undelivered messages.
Rates: As always, message and data rates may apply for any messages sent to you from us and to us from you.
Privacy: ShipLogix respects your privacy. We do not sell, rent, or share SMS consent data or phone numbers with third parties for their marketing purposes.
4. Payments and Billing
Payment Processing: We use Stripe and Melio to process payments. By using our service, you agree to the terms of these third-party processors.
Billing Cycle: For small brands, we maintain a card on file and process payments on a weekly basis. For enterprise accounts, we provide consolidated weekly/monthly invoices.
Accuracy: You are responsible for providing accurate billing and shipping information. ShipLogix is not responsible for delays caused by inaccurate data.
5. Shipping, Liability, and Claims
Carrier Responsibility: ShipLogix acts as a freight solicitor/consolidator. The physical transportation of goods is performed by third-party carriers. The carrier, not ShipLogix, is responsible for the actual delivery and physical safety of the cargo.
Claims Process: All claims for lost or damaged shipments must be submitted to ShipLogix within fifteen (15) days after the shipment date. Claims submitted after this window will not be processed.
Insurance: ShipLogix provides insurance for every package up to a $100 retail value. For values exceeding $100, the user must purchase additional insurance or assume the risk of loss.
Force Majeure: ShipLogix and its partner carriers are not liable for delays or failures in performance resulting from "Acts of God," including but not limited to extreme weather, natural disasters, strikes, or port closures.
6. User Responsibilities
Users are responsible for ensuring that all shipped items comply with local, state, and federal laws. ShipLogix reserves the right to refuse service for items deemed hazardous or illegal.
7. Governing Law and Dispute Resolution
Jurisdiction: These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Arbitration: Any dispute arising out of or relating to these Terms or our services shall be settled by binding arbitration in Los Angeles County, California, rather than in court. You waive any right to participate in a class-action lawsuit.
